New Hampshire is in the majority of states with fault car accident laws. In fault states, recovery is allocated proportionately based on each party’s role in the collision. In the case of rear-end collisions, the struck driver may be held at least partially responsible. This holds true for drivers who were rear-ended while disobeying traffic laws.

If drivers are found to be equally responsible for the collision, they each may be able to file for damages. However, if one driver is considered to be at least 51 percent at fault, he or she may be responsible for the other driver’s damages. In addition to being compensated for vehicle damage, drivers may receive damages for lost wages, medical bills incurred as a result of the accident, or emotional pain and suffering.
